The fine print.

  1. Instructions on how to enter the Master Your Craft 2019 competition (“the Competition”) and details regarding the Competition contained herein form part of these Terms and Conditions. Entry into and participation in this Competition is deemed acceptance of these Terms and Conditions. This Competition is not valid in conjunction with any other offer, competition or promotion by RØDE.
  2. The Competition is free to enter and open to any person eighteen years and above, except employees of RØDE. The Competition will be void in any other jurisdiction where it is prohibited.
  3. The Competition commences at 12.00 midday AEDT on 22 October 2019 (“the Commencement Date”) and closes at 12.00 midday AEDT on 3 December 2019 (the “Closing Date”). The period between the Commencement Date and the Closing Date shall be the Competition entry period (the “Competition Entry Period”).
  4. To participate in the Competition, an Entrant must write, create, record and edit in a digital video format a film (the “Entry Film”), of a minimum of 60 seconds and a maximum of 3 minutes in duration, that demonstrates why the Entrant should selected to win the 12-month internship with RØDE that is part of the Prize.
  5. The Entry Film must not have been entered previously in any past “Master Your Craft” competitions, and the Entrant must own the whole of the copyright in the Entry Film. In circumstances where the Entry Film or parts thereof are derived from or contain images, sounds or material from an existing work, the Entrant must have obtained written copyright clearance from the owner of that existing work for the use of that existing work, which must be produced to RØDE on demand. In circumstances where the Entry Film or parts thereof contain images of persons, locations, marks, trademarks and any other images which would require permission for their use, the Entrants must have received appropriate written releases for their use which must be produced to RØDE on demand. The Entrant shall indemnify RØDE in respect of any and all liability arising from any infringement of any rights whatsoever that may arise in respect of the Entry Film, and RØDE reserves the right to disqualify any Entrant who does not comply with the conditions set out in this clause.
  6. The Entry Film must not defame any person or entity, or be disparaging to any religion, race, or nation, or contain language that is lewd, obscene or inappropriate, or use any copyrights, images, marks, trademarks or logos for which the Entrant has not obtained permission for their use. RØDE reserves the right to disqualify any Entrant who does not comply with the conditions set out in this clause.
  7. The Entry Film must use the “Master Your Craft” title card, which will be provided by RØDE as a download from the Master Your Craft website, as the first shot, for a minimum of three (3) seconds.
  8. The Entrant shall be the one individual person most responsible for the creation, filming, producing and editing of the Entry Film.
  9. To enter the Competition, after the Commencement Date and prior to the Closing Date, the Entrant must first download the Title Card by accessing the website rode.com/myc by entering their email address. The Title Card will then be made available to download.
  10. Once the Entry Film has been completed and prior to the Closing Date, the Entrant shall enter the Competition as set out in paragraphs 11 to 16 inclusive.
  11. For all entrants other than entrants who reside in China, visit the YouTube website, upload the Entry Film to YouTube adding ‘Master Your Craft’ to the Entry Film name and follow YouTube’s required steps to submit the Entry Film. Entrants must comply with any applicable rules of YouTube for this purpose.
  12. For all entrants who reside in China, visit the YouKu, Tencent Video or Bilibili website, upload the Entry Film to YouKu, Tencent Video or Bilibili adding ‘Master Your Craft’ to the Entry Film name, and follow YouKu, Tencent Video or Bilibili’s required steps to submit the Short Film and the BTS Film. Entrants must comply with any applicable rules of YouKu, Tencent Video or Bilibili for this purpose.
  13. Thereafter and prior to the Closing Date, the Entrant must access the Competition Entry Page at the website www.rode.com/myc, and complete the Competition Entry Form by entering the details required therein in full, including but not limited to the full name of the Entrant, the gender of the Entrant, the address of the Entrant and other contact details required, the YouTube, YouKu, Tencent Video or Bilibili links to the Entry Film, and any other information requested therein.
  14. The Entrant shall then receive an email confirming receipt of their entry by RØDE.
  15. RØDE shall aim to moderate each entry within forty-eight (48) hours of receipt, but moderation may take longer due to the volume of entries from time to time.
  16. If the entry is not accepted by RØDE following moderation, the Entrant shall receive an email from RØDE to the effect that it has not been accepted, the reasons for this, and details for the re-submission of their entry once any defects in their entry have been rectified to the satisfaction of RØDE.
  17. Entrants must complete all the steps itemised in paragraphs 11 to 16 inclusive, to the satisfaction of RØDE in its sole discretion, within the Competition Entry Period. RØDE will only accept entries made outside the Entry Period at its discretion.
  18. By entering the Competition, Entrants acknowledge, agree and declare that they are aware that their participation is entirely at their own risk and that they hereby waive, surrender and relinquish in favour of RØDE all claims of any nature and howsoever arising (including as a result of negligence) which but for this waiver, surrender and relinquishment they may or otherwise have against RØDE either directly or indirectly arising out of their participation in the Competition.
  19. By entering the Competition, Entrants hereby warrant that all information submitted is true, current and complete. Any Entrants who have supplied incomplete, inaccurate or fraudulent information may be automatically disqualified. RØDE reserves the right to disqualify any Entrant if RØDE has reasonable grounds to believe that an Entrant has breached any of these terms and conditions or has tampered with the Competition process. Failure by RØDE to enforce any of its rights at any stage of the Competition does not constitute a waiver of those rights.
  20. Incomplete, indecipherable or illegible entries will be deemed invalid. Entrants bear all responsibility to ensure that their entry is complete and legible, and that their Entry Film is submitted in the correct format and clearly visible and audible.
  21. Entrants are entitled to submit an unlimited number or entries, provided that each entry must comply with the entry provisions set out in paragraphs 11 to 16 inclusive.
  22. The costs of entering the Competition shall be borne solely by the Entrant.
  23. The Entrant grants to RØDE a nonexclusive, irrevocable license to RØDE to publish their Entry Film in full on the Master Your Craft website and communicate their Entry Film to the public in the territory of the world, and in full or in part in any other promotional material of RØDE, for the purposes of the Competition.
  24. The winner(s) of Master Your Craft Category shall be determined as follows:
    1. After the Closing Date representatives appointed by and from RØDE with appropriate qualifications shall view all of the Entry Films;
    2. The appointed representatives may thereafter take such additional steps and request such additional information from Entrants as they consider reasonable to determine a winner(s), which may include conducting interviews with shortlisted Entrants;
    3. The appointed representatives shall determine the winner(s) in their sole discretion, and inform RØDE of their decision;
    4. The judging shall be based only on the subjective personal opinion of RØDE’s appointed representatives and shall be final;
    5. RØDE shall announce the winner(s) of this category within twenty-four (24) hours of the determination of the winner(s) on the Master Your Craft website, RØDE’s Facebook, Twitter and Instagram accounts and by email to the winner(s); and
    6. The winner(s) shall be entitled to receive the Master Your Craft Prize.
  25. The winner(s)(s) of Master Your Craft Category will be offered the opportunity to work as a member of the RØDE in-house video production crew for up to 12 months (the “Prize”).
  26. The position will be paid a salary of at least AUD $40,000 per annum, pro rata for periods of less than 12 months. RØDE will cover return economy class airfares from the airport nearest to the winner(s)’s home to Sydney, Australia. RØDE, at its discretion may provide living expenses, including accommodation, food, local transport to and from work, medical insurance and reasonable spending money. The details of how the reasonable living expenses will be paid, and what will be covered, will be discussed with the winner(s) prior to the winner(s) accepting the prize. The winner(s) will be responsible for all legal and tax liabilities that may arise as a result of them accepting the prize.
  27. The position will be based at RØDE’s Australia HQ, in Silverwater, Sydney. It will be full time, with normal work hours 8.30am to 5pm, Monday to Friday. There may be some requirements to work in the evening or at weekends as specific projects demand. The winner(s) will be eligible for up to 20 annual leave days over 12 months, pro rata if the winner(s) is working at RØDE for less than 12 months.
  28. The exact duties and position will depend on the skills and experience of the winner(s), but could be expected to include video pre-production, assistant camera operator or camera operator, sound recordist, boom operator, editor or editor’s assistant, archiving, file management, set ‘runner’, location scouting, research, artist liaison as well as other tasks directly related to the function of RØDE’s in-house video production team. Structured training opportunities may also be included as part of the prize.
  29. If the winner(s) does not have eligibility to live and work in Australia, RØDE will assist the winner(s) in applying for an appropriate Australian working visa, including any necessary nomination. There are a number of different visa types that may apply, but note that they have different eligibility requirements and maximum stay periods. This means that the actual period the winner(s) is a part of the RØDE team in Australia may be less than 12 months, as determined by the visa type they are eligible for. Note that some of the visa types are dependent on factors such as age, nationality, relevant educational or work experience, English language ability and other such factors.
  30. RØDE will pay for any Australian visa application fees that may apply, but will not be responsible for any local fees that may be payable to obtain documentation needed as part of the visa application process (for example, but not limited to, passport application fees, police checks, character references, medical certificates etc).
  31. If the winner(s) is not currently eligible to work in Australia and does not qualify for any of the Australian visa types that would allow them to work in Australia as part of the RØDE team, then the winner(s) will forfeit that part of the prize. RØDE may, at its discretion, offer this part of the prize to the second placed winner(s) in Master Your Craft Category, and so on further down the list.
  32. Note that the likely eligibility of entrants for an Australian work visa may be considered as part of the judging criteria for Master Your Craft Category.
  33. The winner(s) will be required to enter into a maximum term employment contract with Freedman Electronics Pty Limited t/as RØDE Microphones to cover their period working at RØDE, or such other appropriate arrangement depending on the type of engagement permitted by the visa category under which the winner(s) is eligible to work in Australia. The employment contract will cover details such as hours of work and expected conduct. Any breach of the employment contract that may occur whilst the winner(s) is working at RØDE may lead to the employment contract being terminated, as set out in more detail in the employment contract itself. If the employment contract is terminated early, RØDE shall from that point forward only be responsible to pay for flights to enable the winner(s) to return to the winner(s)’s home airport, and any other expenses that may arise due to such early termination shall be the responsibility of the winner(s).
  34. Whilst in Australia, the winner(s) must abide by all applicable local laws and regulations, and must ensure that they comply with the terms and requirements of the visa under which they become eligible to work at RØDE. Any fines, legal costs or sanctions that may arise owing to the winner(s) failing to abide by local laws, regulations and the terms of their visa shall be the sole responsibility of the winner(s).
  35. The winner(s) agrees to take part in publicity and promotion relating to the competition and to the prize as required by RØDE. RØDE will meet any incidental expenses incurred during any such activity.
  36. RØDE reserves the right to not appoint a winner(s) to Master Your Craft category if, in its sole opinion, no suitable candidates for the prize are available from the pool of entrants for Master Your Craft
  37. RØDE reserves the right to alter The Prize in whole or in part at any time. Any changes to The Prizes shall be notified by RØDE from time to time as the case may be.
  38. The Prize on offer in the Competition, in full or in part, are non-transferable, non-negotiable, non-refundable, are not redeemable for cash, and are subject to availability.
  39. The first 600 entrants accepted by RØDE pursuant to paragraph 10 above shall be entitled to receive a free ‘RØDE logo’ T-Shirt. RØDE shall not be liable for any delays in delivery of the t-shirts. RØDE shall not be liable for duty and import costs for shipping of the T-Shirts. Any duty of other import costs for the T-Shirts shall be paid by the Entrants.
  40. The winner(s) agrees to participate in reasonable post-competition publicity for RØDE at RØDE’s expense, including but not limited to their attendance for interviews, photographs, videos and any other promotional activity specified by RØDE, and grant a nonexclusive, irrevocable license to RØDE to use their name, biographical details, photographs, videos, likenesses and any other information regarding the winner deemed appropriate for use by RØDE for any promotional and marketing purposes by RØDE for a period of one (1) year from the Closing Date.
  41. Each Entrant warrants that they have no other agreements or arrangements with any third parties relating to the performance, service, image, name or likeness and/or other rights that may interfere with his or her entry into the Competition and the execution of their obligations as the winner(s) in this Competition.
  42. The terms and conditions of a related third-party supplier or suppliers of prizes may apply and shall be accepted by the winner or winners.
  43. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of RØDE, RØDE reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.
  44. Any cost associated with accessing the Competition website is the Entrant's responsibility and is dependent on the Internet service provider used. RØDE makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Competition.
  45. Except for any liability that cannot be excluded by law, RØDE (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of this Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under RØDE's control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by RØDE) due to any reason beyond the reasonable control of RØDE; (d) any variation in the type and specifications of the prizes to that stated in these Terms and Conditions; (e) any prize that has not been received by the claimant after dispatch by RØDE; (f) any prize that has been damaged in transit; (g) any tax liability incurred by an Entrant; or (h) use of the prizes.
  46. RØDE collects personal information of the Entrants in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as required by law, to Australian or other regulatory authorities. Entry to the Competition is conditional on providing this personal information, and the Entrant must consent to the use of their personal information for the purposes of the Competition. RØDE may, for an indefinite period, and provided that the Entrant has not withdrawn their consent, use the information for promotional, marketing, publicity, research and/or profiling purposes, including sending electronic messages or telephoning the Entrant. The Entrant may opt out of any promotional, marketing, publicity, research and/or profiling conducted by RØDE using their personal information at any time by giving RØDE notice of their intention to opt out. RØDE shall maintain all personal information in accordance with its Privacy Policy set out at http://www.rode.com/privacypolicy. Entrants should direct any request to access, update or correct information to RØDE.
  47. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia. Entrants agree to submit to the non-exclusive jurisdiction of the courts of the State of New South Wales, Australia. RØDE shall comply with any laws applicable in the location where the Competition is held.
  48. RØDE hereby reserves the right to change, suspend or cancel the Competition, or to change these terms and conditions, by notice on the RØDE website. RØDE shall not be required to specify any reasons for the changes and shall not incur any liability as a result.

  1. Information on how to enter and prize details form part of these terms & conditions (Terms of entry). The Terms must be read in conjunction with the Schedule. The Schedule defines the terminology used in these Terms of entry. Where there is any inconsistency between these Terms and the Schedule, the Schedule prevails. Participation in this Promotion is deemed acceptance of these Terms of entry.
  2. Entry is open only to legal residents of the Eligible States/Territories who satisfy the Method of entry. Directors, officers, management, employees, suppliers (including prize suppliers) and contractors (and the immediate families of directors, officers, management, employees, suppliers and contractors) of the Promoter and of its related bodies corporate, and of the agencies and companies associated with this Promotion, including the competition permit providers TPAL (Trade Promotions and Lotteries Pty Ltd) are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  3. The Promotion will be conducted during the Promotion period.
  4. The Prize/s are specified in the Details of prizes section of the Schedule.
  5. The total prize pool is specified in the Total prize value section of the Schedule.
  6. Any prize is valued in Australian dollars unless expressly stated to the contrary.
  7. Entrants are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize(s). The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Entrants are responsible for any and all expenses that they incur in entering the competition and they will not be reimbursed regardless of whether or not they win the competition.
  8. The entrants must follow the Method of entry during the Promotion period to enter the Promotion. Failure to do so will result in an invalid entry. The Promoter will not advise an Entrant if their entry is deemed invalid.
  9. The time of entry will be deemed to be the time the entry is received by the Promoter.
  10. Entrants may submit up to the Maximum number of entries (if applicable).
  11. The Promoter accepts no responsibility for any late, lost, delayed, incomplete, incorrectly submitted, corrupted, illegible or misdirected entries, claims or correspondence whether due to omission, error, alteration, tampering, deletion, theft, destruction, disruption to any communication network or medium, or otherwise including those entries not received by the Promoter for any reason. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. No correspondence will be entered into.
  12. The prize(s) will be awarded to the valid entrant(s) drawn randomly in accordance with the Prize draw details. The Promoter may draw additional reserve entries (and record them in order). In the event of an invalid entry or an ineligible entrant, or if the entrant is ineligible to accept the prize, the prize will be awarded to the first reserve entry drawn. If the prize can’t be awarded to the entrant drawn, the promoter will then continue this process until the prize is awarded.
  13. The winner does not need to be present at the draw unless expressly stated to the contrary.
  14. The winner(s) will be notified in accordance with the Notification of winners and Notification of unclaimed prize winners (if applicable) sections of the Schedule. Notification to winners will be deemed to have occurred on the later of the time the winner receives actual notification from the Promoter or two business days thereafter. The notification will include details about how the prize(s) can be claimed.
  15. The Promoter takes no responsibility where it is unable to contact prize winners who have not provided correct or complete contact details. If an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to modify any entry information should be directed to Promoter.
  16. It is a condition of accepting any prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
  17. The winner(s) name and state/territory of residence will be published in accordance with the Public announcement of winners section of the Schedule (if applicable).
  18. If the prize(s) has not been claimed by the Unclaimed prize draw time and date and subject to any written directions from a State lottery agency, the Promoter may conduct an Unclaimed prize draw in accordance with the Unclaimed prize draw section of the Schedule (if applicable). In the event the Unclaimed prize draw takes place, the Promoter will attempt to contact the winner(s) of the Unclaimed prize draw in accordance with the Notification of unclaimed prize draw section of the Schedule, and if applicable, the name and State/Territory of residency of any winner(s) of the Unclaimed prize draw will be published in accordance with the section of the Schedule entitled Public announcement of winners from unclaimed prize draw. If a prize is no longer available the promoter may substitute with a prize of higher or equal value subject to any written directions from a regulatory authority. The promoter is not allowed to deduct any administrative costs associated with provision of the prize.
  19. To the greatest extent permitted by law, the Promoter excludes all warranties, representations or guarantees (Warranties) regarding the Promotion and any prizes, including any Warranties which may have been made in the course of advertising or promoting the Promotion. The conduct of the Promotion or the supply of prizes may involve third parties, and the Promoter makes no Warranties and disclaims all liability in connection with any such third parties, their acts or omissions. By entering the Promotion, an entrant releases and indemnifies the Promoter and its related bodies corporate (including the officers, employees and agents of each) from and against all actions, penalties, liabilities, claims or demands the entrant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the Promotion or winning or failing to win a prize, or using or permitting any other person to use the prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.
  20. If despite the foregoing clause, the Promoter incurs a liability to an entrant under any law which implies a Warranty into these Terms of entry which cannot legally be excluded, the Promoter’s liability in respect of the Promotion is limited, in the Promoter’s discretion, to either resupplying such goods or services as form part of the Promotion, or paying the cost of resupplying those goods or services.
  21. Without limiting any of the foregoing, in no circumstances will an entrant or the Promoter have any liability to the other for any loss or damage suffered which is indirect or consequential in nature, including without limitation any loss of profit, loss of reputation, loss of goodwill, or loss of business opportunity.
  22. The Promoter and its associated agencies and companies will not be liable for any delay, damage, or loss in transit of prizes.
  23. The Promoter may in its absolute discretion not accept a particular entry, may disqualify an entry, or cancel the entire Promotion at any time without giving reasons and without liability to any entrants, subject to any written directions from a regulatory authority. Without limiting this the Promoter reserves the right to verify the validity of entries, prize claims and entrants and to disqualify any entrant who submits an entry or prize claim that is misleading or not in accordance with these Terms of entry or who manipulates or tampers with the entry process. In the event that a winner breaches these Terms of entry, the winner will forfeit the prize in whole and no substitute will be offered. Verification is at the discretion of the Promoter, whose decision is final. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  24. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, subject to any written directions from a regulatory authority. Where a prize is unavailable for any reason, the Promoter may substitute the prize for another item of equal or higher value subject to any written directions from a regulatory authority. The Promoter accepts no responsibility for any variation in prize value (including between advertising of the Promotion and receipt of the prize).
  25. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability (or that of a third party involved with the Promotion) to proceed with the Promotion on the dates and in the manner described in these Terms of entry, including but not limited to vandalism, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter’s obligations in respect of the Promotion will be suspended for the duration of the event and, in addition, the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions, subject to approval of the relevant authorities.
  26. All entries become the property of the Promoter. As a condition of entering into this Promotion, entrants agree to assign all their rights in and to their entry and any related content to the Promoter, including any copyright or other intellectual property rights in the entry and related content. Without limiting this, the Promoter may use entry content for any and all purposes including commercial purposes. You warrant that entry content is original, lawful and not misleading and that the Promoter’s use of such content will not infringe the rights of any third parties. The Promoter has no obligation to credit you as the author of any content submitted and may otherwise do any acts or omissions which would otherwise constitute an infringement of any moral rights you may have as an author of content.
  27. Entrants consent to the Promoter using the personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes, including to third parties involved in the promotion and any relevant authorities. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter including third parties may, for an indefinite period, unless otherwise advised, use the private information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
  28. The collection and disclosure of personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy statement which adheres to the Privacy Act 1988 (cth) and Australian Privacy Principles.
  29. The Promotion and these Terms of entry will be governed by the law of the State or Territory in which the Promoter ordinarily resides. Entrants accept the non-exclusive jurisdiction of courts and tribunals of that State or Territory in connection with disputes concerning the Promotion.
  30. Facebook, YouTube, Instagram, or Snapchat may be used to advertise or promote the Promotion. By entering the Promotion, entrants agree that the Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, YouTube, Instagram, or Snapchat; and to release Facebook, YouTube, Instagram, or Snapchat from all liability in relation to this Promotion. Any questions, comments or complaints regarding the Promotion should be directed to the Promoter and not Facebook, YouTube, Instagram, or Snapchat.
